1. Acceptance
By using "Monkey Around" (the "Game") from Banana Bunch, LLC ("Company," "we," "us"), you agree to these legally binding Terms of Service ("Terms").
2. License & Ownership
We grant you a limited, revocable license to use the Game for personal, non-commercial use. All rights, title, and interest in the Game remain with the Company.
3. User Conduct
You are responsible for your account and conduct. You agree not to: (a) use the Game unlawfully; (b) harass, cheat, or defraud others; (c) disrupt the Game's services; (d) attempt unauthorized access to any system; (e) share modified game files; (f) attempt to hack/modify the game; or (g) bypass loopholes in these terms.
4. Virtual Purchases & Content
All in-game purchases are final and non-refundable. Virtual items are licensed, not sold, and have no real-world value. We may modify or remove virtual content at any time.
5. Termination
We may terminate or suspend your access to the Game immediately, without notice or liability, for any breach of these Terms. Termination, including account banning, is administered through our service providers (including Microsoft Azure PlayFab). Upon termination, your right to use the Game ceases.
6. Disclaimer & Limitation of Liability
6.1. THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
6.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE GAME.
6.3. YOU EXPRESSLY AGREE THAT THE COMPANY IS NOT LIABLE FOR ANY PERSONAL INJURY, BODILY INJURY, MENTAL DISTRESS, ADDICTION, OR DAMAGE TO PROPERTY RESULTING FROM YOUR USE OF THE GAME OR VIRTUAL REALITY IN GENERAL. YOU USE THE GAME AT YOUR OWN RISK.
6.4. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST SIX MONTHS.
7. Indemnification
You agree to indemnify and hold Banana Bunch, LLC harmless from any claims resulting from your use of the Game or violation of these Terms.
8. Governing Law & Changes
These Terms are governed by the laws of the State of Delaware. We may modify these Terms; your continued use of the Game constitutes acceptance.
